Salary and Form 16 of last year not received

I have been working with Dess Computers Pvt Ltd since June.

I left my job in Jan due to irregular and delay in payments of salary. I was working on Consultancy basis in which I had to put in 90 hours in a month and would be paid 31, 000 each month.

I had not got my salary of Dec and Jan.

I had also put in extra 55 hours for some project for which I was due some money.

It has been more than an year that I have left but they have still not paid me.

I have been continuously calling them for my salary but they do not pick up my phone or respond to my sms.

I asked them for my Form 16 for year 2011 which they have not given me.

Since I was working on consultancy basis they used to deduct 10.5 % of my salary each month (nearly 3000) and paid the same to IT. I used to file my returns each year by Form 16 they used to provide me.

Last year they deducted the 10.5% each month from my salary but has not paid the same to IT and hence are not giving me my Form 16.

I file my returns every year and last year I am unable to do so.

Also each year on filing returns, I would get 20000 to 30000 return check from IT.
