NON PAYMENT OF DUES BONUS, PF

Sub: Non payment of dues by Datamation Pvt. Ltd, Plot No No. 3 &4, Hassanpur, I.P. Extension, Patparganj, New Delhi – 92 PF & Bonus.

Sir,

Kindly refer to letter dt. 7.12.2009 (copy enclosed). I want to draw your kind attention towards the following points for compliance noted below:-

1. According to letter dt. 7.12.2009 (copy enclosed) from Datamation Pvt. Ltd, I became to know that the delay in processing of PF Form due to incomplete form. This is the duty of company to fill up the form properly and submit it in PF office.

2. On dated : 3.10.2009 when I have sent form to company which is enclosed on Annexure No…………I have mentioned that I have joined on dt. 17.7.2007. But concerned person of office has changed the date of joining as 1.8.2007 instead of 17.7.2007.

3. As per rules & regulations of the Bonus Act 1965 the details as follows:

(a) It is applied for all Companies/Establishments in which twenty or more persons are employed on any day during accounting year. (30 days).

(b) A minimum bonus shall be 8.33% of the salary wage earned by the employee during the accounting year.

4. According to letter No. ID/07/RTI/09/12 dt. 8.12.2009 (copy enclosed) from the Office of Labour Commissioner, Govt. of NCT. Of Delhi in point No. 23 they have cleary mentioned that employee is eligible for bonus, if he has worked for 30 days and payment is applicable on establishement/companies.

5. The Rules of the minimum wages act are not followed by company. They cut the payment of Sunday, but as per Minimum Wages Act, if any employees has worked for 6 days he is eligible for Sunday rest

6. As per the rules and regulations of Minimum Wages Act, 1948 is that:-

• Provide a day of rest in every period of seven days and for the payment of remuneration in respect of such days of rest.

• Provide the payment of work on a day of rest at a rate not less than time rate.

• Provide for the issue of wage books and wage slips and prescribe the manner of making and authenticating entires in wage books and wage slips.

Kindly order the enquiry into the matter and take strict action against the company for not giving my Bonus with interest upto till date at the earliest and possible w.e.f. 17.7.2007 to 31.3.2008 and they sent me the copies of my Salary Registers w.e.f. 17.7.2007 to 31.3.2008.
