Defective handset

I have purchased this nokia 2630 set on last 06-12-07 from a dealer at baruipur, near station road, kolkata-700144. but from that very day the set is getting hanged again and again without touch. the set was manufactured on september'07. now the dealer is denying to return back the money. PLEASE DO THE NEEDFUL
