Pension fund withdrawal not received

I worked with Asian Paints India Limited from 1st Dec 1997 to 7th Jul. After my resignation I had submitted the required forms to HR department of Asian Paints to get the settlement of my PF & Pension accounts.

I received the settlement of my PF account in Nov but never received settlement of Pension account. I contacted Asian Paints –Mr Huzefa Retiwala hundreds of times over phone / mails and every time he replied that form has been submitted to PF department and pending for settlement.

I had written the following letter to PF office Bandra via Regd AD post but even after 2 months I have not received any response. Also I had written 2 mails on [email protected] twice on 26th May and 11th Jun.

I request you to guide how do I get my claim settled

Respected Sir.

I worked with Asian Paints India Limited from 1st Dec 1997 to 7th Jul. After my resignation I had submitted the required forms to HR department of Asian Paints to get the settlement of my PF & Pension accounts.

I received the settlement of my PF account in Nov but never received settlement of Pension account. I contacted Asian Paints –Mr Huzefa Retiwala hundreds of times over phone / mails and every time he replied that form has been submitted to PF department and pending for settlement.

In March Mr Huzefa said that there is no point in following-up for old form and asked me to fill the new form. Accordingly I filled a new form and submitted to Mr Huzefa. He in-turn submitted form to you and sent me the acknowledgement copy proving that the form was submitted to you in April.

I visited your Bandra office sometime in 2006 to check the status of my form which was submitted to you in Apr. I met Mr Chanda in your office and requested him to locate my form, he checked all the relevant records and finally replied that form was not with PF office. On the contrary Asian Paints is claiming that form has been submitted (Enclosing photocopy of the acknowledgement)

It is almost two years after submission of new form I have still not received my money to the credit of my pension account.

Under RI Act I request you to furnish the reasons that “Why my account has not been settled so far even though the form has been submitted 2 years back (here I am considering new form which was sent to you in Apr)

As there is no fixed fees for an enquiry under RI Act I herewith enclose a blank cheque 158634 towards the fees for asking a query under RI Act 2005. I request you to fill the necessary amount and send me the receipt. You may also add courier charges (for sending the receipt) and fill the consolidated amount in the cheque.

I am sending the form 10C duly filled for the third time and request you to settle my claims within 30 days of receipt of this communication, failing to which will compel me to take legal action against your department.

Last but not least I need detailed working of interest calculation along with settlement funds to enable me to check that there is no financial loss to me on account of this delay.
