XPS 1530 battery malfunction

I had bought DELL XPS 1530 on 11/05/09 with a 1 yr. warranty from a Dell retail outlet. Now on the 26/04/09 the battery malfunctioned and now fails to charge beyond 33%.I called up DELL on 28th and their immediate reaction was that my warranty has already expired on 13/03/09. I tried to make them understand that a laptop bought in MAY cannot have its warranty expired in MARCH but to no heed. Then i emailed them a copy of my bill. Realizing the loophole in their argument now the Dell person told me that i had overused my battery and that they would not replace the battery, under any circumstances. I tried talking to a higher up technical person but he also went ahead with the same excuse. I do not understand how a battery with average life of 3yr. go down in 10 months, if its not faulty. How do Dell people know that i have overused the battery without even inspecting my laptop? They are not budging from their farce excuses and have already forwarded me a quotation to buy a new battery. This is a serious case of cheating and fraud that i have been subjected to from DELL
