Relieved without account settlement

Dear Sir,

I have the receipt of the Notice/relieving Letter no TL/09-521/649 dated 01/08. It was received on 18/08, 12.30 PM at Indore office. It was issued by TL, PMC on the same day and received by us under protest. The way company relieved a regular employee astonished me and creates a great disappointment. I strongly protest my right and benefits against this short term relieving. The panic situation created by the company and I am under a great stress.

There are some points observed, when I was gone through the letter. The date mentioned on the letter is 01/08 though the letter was received on 18/08 by courier. Either It is a mistake or shows bad intension of the company. The notice given to us is very short i.e. 13 days only in place of 60 days. There is no detail found regarding other benefits like Gratuity amount deducted each month from salary, leave encashment, performance Bonus etc.. Our company is registered in ROC as a private limited company under company act but its behavior is nothing more than a man power supplier.

In brief, I joined company as a Quantity surveyor on 01/05 vide letter no. ITL/06-105/PMC-IND/045 dated 07/04 and Joining report at Indore dated 01/05.My services got confired with effect from01/11 with letter no. ITL/06-105/PMC-IND/300 dated 15/11. I was appointed as a acting team leader in the absence of Team leader vide letter no. ITL/06-105/PMC-IND/353 dated 29/01. I got promotion as a Bridge Engineer W.e.f. from 10/09 vide your letter no. ITL/APPT/08/238 dated 08/09. I got relieved vide letter no. TL/08-521/587 dated 30/04. Again a notice received by you for the cancellation of this relieving letter vide letter no. TL/08-521/580 dated 16/06. And finally I got your relieving Letter no TL/09-521/649 dated 01/08.

During 28 months of my job what ever work responsibility was given by the client to me I performed successfully. I also taken charge of highway engineer, Acting team leader, Bridge engineer etc. unconditionally. Also I want to mentioned here that during my service tenure my services is found satisfactory and completed the project within stipulated time.

I also want to share our working experience here regarding our project and our working during the project. This Indore-Khalghat project is the prestigious and high valued project of the Indore region and MP. Initially it was delayed by about 1 year and impossible to complete on scheduled time. The EPC tried his level best and with the support of PMC they complete the project 1 month before the stipulated time. Every body including media, NHAI, beneficiaries appreciate the achievement. All said that it is a miracle. All the deputed agencies, employed persons have worked with full responsibility and given all possible support to Concessionaire. Every body faced tough situation and spent his valuable extra times to our project when the quantum of work was on the peak and a huge work pressure on us. We never demanded from you for extra manpower, weges and managed the work pressure with available work force and resources.

As regarding support from ITL HQ it is almost nil except salary draft on each month. Every employee in EPC is benefited with bonus, promotion etc. The EPC open heartedly appreciated our team and company as well. Also they interested in giving work to our team for his forthcoming projects. Now at last a verdict issued by company and we got dismissed by company as a reward of good work. This incidents known to almost 500 engineers and all project related companies and ITL may be defamed due to this last incident.

Could I ask one question here how company is writing on offer letter for 2 months notice period, Bonus, deducting Gratuity etc. without having sufficient reserved fund and projects in hand on their account/company for regular employee?

Though I got my sevices confirmed in writing vide your letter no. ITL/06-105/PMC-IND/300 dated 15/11. As per para 4 (b) of my appointment letter vide ITL/06-105/PMC-IND/044 dated 07/04 which state that after confirmation the employment can be terminated by giving Two month notice if the length of services is two years and above; but less than three years.

Now the company is relieving me, and in the light of above fact the following are the dues must be settled and are as under:

1. wages for 47 days for Short notice 84986.00

2. Performance Bonus 1 month salary 55000.00

3. Gratuity deducted from salary 24673.00

4. Interest on Gratuity 2500.00

5. Leave encashment for 15.75 days 28479.00

6. Damages of social and mental Health 100000.00

Total INR 295638.00

You are requested to take action against the company for the settlement of dues Rs. 295638.00 as at your best possible end.
