Defect developed in the Tyre

I had bought 4 new tyres from the Company's dealer at Chembur, Mumbai on 13.09.2008. Within a week I drove in my car with these tyres. A bulge (bubble) was seen on the wall of one tyre on reaching Pune. Two days later when I went to show this defect to the Dealer we noticed a deep hole near the bubble. This hole could have led to tyre burst with grave consequences. The dealer kept the defective tyre which was shown to the representative of the company. The company person handed over to me a report on this tyre. They claimed that this defect had developed due to road hazard such as kerbhit/pothole. As is evident from the route that my car had traveled it cannot be the case. There is neither a kerb nor a pothole on the expressway. Initially I requested the dealer to replace the tyre. Later on I requestd to the company to take back all the tyres and refund me my money. The company did not seem to care for my safety and so along with the refund I also demanded a compensation of Rs.1 lakh for puting my life in danger AND causing me mental trauma. My suggestion to the company for ascertaining the cause of this defect by testing the tyre with a neutral agency was not responded. I had let the rubber manufacturers' research association at Thane inspect these tyres. Prima facie they were of the opinion that it was a manufacturing defect. The company's response was shokingly irresponsible. I have the photos and can arrange to send them seperately as I dont know how to attach them here.
