Rejection of service within warranty period

I had purchased a Nokia 3500 classic cell on 25th November from M/s “Hot Spot”, Mahalakshmi Layout, Bangalore – 560 086, Karnataka, India, vide bill No. 29790748466 with a warranty of one year by the company from date of purchase i.e. from 25.11.2007 till 24.11. for the use of my son Master R Sharat.

During the month of June the cell encountered faulty display and was repaired by the M/s Nokia Care, Malleshwara, Bangalore – 560 003, taking a time period of around 12-15 days for repair. After repair, even though the display was working properly, the radio was not working and the audio clarity was very poor. As I don’t use the radio much and was busy, I could not give it for repair.

Once again during the last week of October the cell encountered faulty display without any liquid or physical damage.

I, once again gave it for repair to M/s Nokia care, Malleshwara, Bangalore – 560 003, on 31st October vide Job Sheet No. 140434038/081031/13. At that time they told that 2 screws were missing. On 5.11.2008 they called up stating that they are not going to repair because some parts are missing. When I went and enquired they said that the cell could not be repaired since warranty is void for the following reasons:

• Two screws missing

• MMC Jack missing

• Unable to open the panel

• Panel full scrachaerat (I am not able to understand the meaning of this)

1. When I received the cell during June from the authorized service center, i.e.M/s Nokia Care, I was not knowing that I am supposed to check, whether the service engineer has fixed all the screws properly or not by asking them to open and re-fix the entire equipment in front of me. Further they stated that the screws which were missing were belonging to display and IC attachment. How can lay man like me is expected to open the cell for repair? I confirm that I have not opened the cell nor gave the cell for repair to any person after taking delivery from the service center during June. Hence I strongly suspect that M/s Nokia Care has not fixed the screws properly at the time of repair.

2. Is it the plan of your service centre, by not to fixing the screws properly, so that next time when the same instrument comes to repair with in the warranty period, they can say the warranty void and charge us for the repair?

3. On the same day when I went to Service Centre for taking delivery of my un-repaired mobile, i.e. on 5.11. one more customer was also having trouble in getting his mobile repaired within warranty period, just like me.

4. While receiving the cell for repair, they handed over the memory card from the cell. They had observed that two screws were missing. But it is surprising why they had not noticed missing of MMC Jack, in spite of handing over the memory card to me, which is supposed to sit inside the MMC Jack?

5. While receiving the cell for repair, in front of my own eyes, they opened the panel and now they are writing that panel can not be opened. What type of engineers they are, to write such nonsense? Is it my problem if they can not open the panel or why they have not written the reason for not opening the panel?

Even though the cell is in within warranty period, they are not repairing it free of cost and they want to charge us.

Thus I would request you to take necessary actions immediately and kindly help me by providing proper service which you are assuring while selling the equipments.

I hope you will surely help me in repairing my cell without any charge and will not give me an opportunity to approach Consumer Forum.
