I would like to mention that following inappropriate charges have been imposed by M/s Assotech Limited which was not part of contract:-
(a). Increase in Balance Outstanding Amount: M/s Assotech Limited mentioned that difference in outstanding amount is due to Govt Order that all payment made in real estate after Apr will be levied extra tax. It is to bring to your kind notice that agreement between Bank and M/s. Assotech was for construction-linked payment plan. The last payment for my flat would have been released by bank on its prescribed time i.e. 29.09. (as per your payment schedule vide letter dt 29/12), if the construction had not been delayed. Since, M/s. Assotech delayed the construction activity thereby causing the bank to disburse the amount in August. Hence, the tax levied on this amount must be bear by the M/s. Assotech as the payment was given based on the delayed construction by it.
(b). Interest on accounts of delayed payment: Firstly, this is to bring to notice that I had opted Construction based planfor payment, for which I paid @1990 per sq ft in place of @1770 per sq ft for other plans (approx 3 Lakhs more than other plan).
Secondly, the delay in the payment was the result of the non-agreement between the Banks and Assotech. I had submitted all documents one by one in four banks (Indian bank, Allahabad bank, Axis bank and finally in Union bank of India) as per directions of Mr Surya Bhan, but banks delayed and refused to loan because M/s Assotech had not provided some documents to bank.
Thirdly, in construction linked payment plan Bank disburse payment to builder if bank satisfies there is considerable level of construction activity. I have always written on time to the Bank for release of amount but M/s. Assotech delayed the construction activity thereby causing the bank to disburse the amount accordingly.
Moreover, it is beyond my comprehension that why company is calling such payment as ‘delayed’. All the payments are made on the time based on the construction level completed by the company. If the Bank was not satisfied with the construction, then I could not force the bank to disburse the amount because it was between bank and the M/s. Assotech to quantify the amount of construction done.
Sir, I have accepted all other irrelevant demand such as extra charges due to increase in super area, POP charges, Power backup charges and high Maintenance charges for super and town ship development which was not part of contract. So please take necessary action and direct to Assotech limited to remove these above mentioned two charges from my demand letter.
