I HAVE BOUGHT A FLAT IN LUV KUSH APPARTMENT, 5 SUBHASH NAGAR, NEAR T.B.SANITORIUM, JAIPUR (DEVELOPED BY BALAJI HEALTHCARE PVT. LTD) IN THE YEAR 2006
DURING THE PURCHASE OF FLAT WE WERE PROMISED
1. COMMUNITY HALL FOR BUILDING USE
2.COVERED PARKING
IN THE YEAR 2009 A SOCIETY WAS FORMED OF THE FLAT OWNERS OF THE BUILDING AND WAS REGESTERED WITH THE APPROPRIATE AUTHORITY.
AS PER THE PROMICE WE WERE ALLOTED COVERED PARKING BUT THE SAME WAS ALLOTED IN SUCH A WAY THAT IT IS CREATING PROBLEM FOR THE FLAT OWNERS, THE ALLOTMENT IS DONE ONE BEHIND THE OTHER.
REGARDING COMMUNITY HALL THE BUILDER IS NOT GIVING POSSESSION OF THE HALL TO THE SOCIETY AND SAYS THAT IT IS HIS PROPERTY AND NOT FOR BUILDING USE AND ALSO WILLING TO SELL THE HALL.
I FILED AN RTI WITH THE JAIPUR DEVELOPMENT AUTHORITY (JDA) TO FIND OUT THE EXACT STATUS OF COMMUNITY HALL AND NUMBER OF COVERED PARKING AS APPROVED BY JDA.
THE MY RTI APPLICATION JDA REPLIED THAT THE COMMUNITY HALL WAS PROPOSED AS PART OF COMMON AREA ALONG WITH STAIRS, LIFT, LOBBY AND IS FOR COMMON USE ON TERMS AND CONDITION LAID BY THE BUILDER.
REGADING COVERED PARKING IT WAS SAID THAT ONLY 10COVERED PARKING HAS BEEN APPROVED IN THE BUILDING AND THE BUILDER IS NOT ALLOWED TO CHANGE THE PARKING PLAN AS PER HIS, WHEREAS THE BUILDER HAS ALLOTED 21COVERED PARKING THE APPARTMENT THERE BY CAUSING PROBLEM IN PARKING OF VEHICLE.
FUTHER THE BUILDER HAS MADE AN ILLEGAL FLAT AT THE TERRICE OF THE THE BUILDING WHICH WAS APPROVED FOR WATER TANK ONLY AND THE JDA IN MY RTI APPLICATION HAS SAID THAT IT WAS UNAPPROVED CONSTRUCTION AND NOT AS PER APROVAL.
PLEASE HELP US IN GETTING THE COMMUNITY HALL AND TO REORGANISE THE PARKING AS PER THE JDA DRAWING.
