CHEATED IN LAND PURCHASE - NOT RETURNING OUR MONEY

I purchased a land of 2000 Sq. Ft at Maouza GADAKAN (P.S. Macheswar, Tahasil - Bhubaneswar, Dist - Khurda, Orissa), Khata No. 692, Plot No. 2775 and Sub Plot No. 20. from “GANAPATI EASTCON PVT. LTD.”, Registration No. U45201OR2009PTC011217 having Head Office at Plot No.: 98, Saheed Nagar, Bhubaneswar-751007, Orissa.

As discussed and finalized with them we had paid an total amount Rs. 7, 00, 000/- @Rs. 350/Sq.ft (Rs. 6, 00, 000 paid vide cheque for which we have money receipt and Rs. 1, 00, 000 paid in cash for which there is no money receipt with us) for the said property and spent another Rs. 60, 000/- for registration. The land registration was done on 24th Dec 2010, but the company did not hand over our legalised Sales Deed (Kabala)after registration.

As we are staying in Kuwait, we called several times and sent many mails and my relatives vissited then several times to collect the Legalised Sales Deed (Kabala), but they gave one or other date to come and collect. Finally, we got a shocking news from one of the Ganapati’s Customer to whom they were trying to sell our property that our land registration cancelled. We were surprised how Ganapati Builder could cancelled our registration without our information/knowledge & approval and why they cancelled the registration after paying the total money.

When we applied for EC, we confirmed that land registration cancelled illegally by Ganapati Eastcon on 8th Mar 2011 without informing us.

Since then, we are keep on calling to Mr. Chinmaya Das- MD, Mr. Tapan Kumar Barala- Asst. GM and Mr. Dhrubananda Barik – GM requesting them to return our money at the easliest. We too sent several mails, but received only one response from Mr. Tapan on 19th April 2011 as below;

Dear Sir,

Sorry for inconvenience I discuss with my MD regarding for your Return money(Booking amount) against Plot No-2775.

Finally MD decided with his managing committee company will return your due money after 30 Days.

This mail itself highlight how serious they are to return our money. Since then they are giving one after one new deadlines to get back our money. Initially, they promised to return our money by end of April 2011. When we spoke to Mr. Chinmay Das- MD on 27th April 2011 and he assured us to wait for one more week and he will positively return the money on or before 07.05.2011. We regret to inform that we have not yet got our money from The Ganapati Eastcon Pvt. Ltd.

It is now going to be 8 months paying our money to Ganapati and more than 6 months from the cancellation of our land registration, but still we are awaiting to get back our money. As we have no faith on this fraud builder, we want our hard money back with interest.

KIndly help us and give us justice.
