Abtronic X2 with Dual Channel Technology
Deficiency in service and reimbursement of the amount along with compensation

That I had ordered for Abtronic X2 with Dual Channel Technology Advanced Microprocessor AND 4 positionable Conductive Pads including batteries, special Abtronic Conductive Gel and a handy Carry Case.

Abtronic X 2, for which payment for an amount of Rs. 5245/- (inclusive of shipping charges) was made through credit card No. 4477 4790 1657 7001 on 12.09.2009 on the same day and the amount was promptly deducted from the account and the order was processed by Mr. Mohinder (Authorization Code: 978087).

That while placing the order through ‘tbuy’ web portal, I was made to believe that you had sufficient number of Abtronic available with your suppliers.

That until I had raised the query regarding its status on the website; you never cared to communicate the unavailability of the product or even cared to explain the delay of more than seven months.

That in spite of repeated telephonic conversations and assurances, the product has not been delivered to me. Finally I in severest terms warned you of legal action and demanded interest and compensation, I was assured that the product would be shipped to him at the earliest however, till date I have not received.

That, after receiving the amount the company had deceitfully concealed the fact that you never had the ability or capacity to supply the handset at the rate quoted in the website and that the whole process was a well planned and concocted effort on your part to make undue profits out of the transaction and that you were never in a position to make any sale as claimed by you on the website.

This transaction has caused immense hardships and agony to my client. I had to pay interest for the amount which was paid out of the credit card which was used for the purchase.

I was put into immense mental hardships and pain a credit crunch by restraining his liquidity for the period the amount is with you. That for the hardships caused and for the period the amount was retained by you till the date amount is reflected in my clients account, you shall be liable to pay compensation and interest which would amount to Rupees one lakh ./- failing which I shall be constrained to take appropriate legal action and also to take steps so as to ensure that no other online customer is defrauded by a fake and fraudulent company like yours and you shalls be held liable for all the cost and consequence arising thereof.
