EMI deducted without loan being transferred

Hi,

I had applied for CAR loan from HDFC bank through an agent. The agent kept on telling us that the documents are still not complete for the loan to be transferred to my account and on Feb 5th the loan EMI of Rs 9186 got deducted from my account without receiving the loan amount from HDFAC bank.

How am i lieable for the EMI untill and unless the loan amount is credited to my account? I have been charged without transferring the funds by HDFC bank.

I have raised the complaint with the customer care of HDFC but have not received any response from them. My complaint no. is 312510075.

Would request for help in getting my money back from HDFC bank.
