Suffering due to Bank Negiligence

A cheque was dropped in ICICI Viman Nagar, Bank on 14.06.2010. It was returned by the ICICI bank clearing saying that the words and figures mismatch. The state of the returned cheque was spoilt, the ink was smudged and the figueres could not be read and the signature of the signing authority was also smudged. This state has happened either at the Viman Nagar Branch or during transit or at the cheque clearing centre.
Now, I have to ask for a fresh cheque in lieu of the spoilt cheque for no mistake of mine. Already I have gone to the authorities who issued cheque (post office) four times and I have to request them to issue a new cheque.
The mistake of bank has caused me much distress, loss of time and money.
I seek an explanation to this regards from the ICICI bank.
