I had taken loan from ICICI bank for purchase of my flat in MIDC Dombivali. The details of loan are as follows
1. Date /Year 2002
2. Loan Amount 3, 50, 000/-
3. Loan A/C No. LBMUM00000370880
They made it mandatory for me to submit the Original Document of this flat as an essential condition of this deal. These papers being legal documents with MIDC, & being proof of my ownership you have Hypothecated them.
I had foreclosed the loan on 27/01 and later on I approached the bank for returning Original Documents of my flat on 04/2 as I have to sale my flat.
I have been informed by your Branch of “ICICI BANK “ MIDC. DOMBIVLI that Documents are missing from the Branch & not traceable which you have accepted through written communication. The inability of the Bank to return the Original documents of my flat has resulted into loss of immediate customer & thereby Financial loss of Rs 30 lac. Not only I had to cancel the deal of selling of my flat priced at Rs 30 lac but has endangered my opportunity to purchase new flat.
I have to pay the full and final amount towards purchase of my new flat before 10/03. This, now, seems to be impossible. Enigmatic situation has emerged due to ICICI BANK’s inability to return me my original Documents. I have borrowed Rs.25Lac from market @ 18% interest per annum to cater to my financial need or else the seller will charge me the same interest rate.
I categorically insist that Bank should assume the responsibility of my loss & to start the process of recreation of my papers with duly paid Stamp Duty and Registration charges and also compensate for my financial loss. ICIC Bank, must expedite to pay for my financial loss due to their inability to make original Documents available. I suggest Bank to pay me the compensation by either of the following Routes.
a) Difference of the selling price of my flat (30l - the new selling price)
b) Reimburse Interest of Rs.37500.0/ month, I will be paying to money lender
c) ICICI BANK – to purchase my flat and pay me Rs.30L
But so far the Bank has not communicated to me about the compensation part. I need to file a complaint against them.
