Death claim amount

My father had a policy no 571389769 but he was died in an accident while returning from the office, after that we have applied for the death benefit amount, but now they are saying only because we paid the premium amount lately after 3 months 9 days later of the due date of premium amount, this is not a valid reason to tell us, anyhow we want our money, if we paid the premium amount lately then definitely my father would have paid the premium amount with the fine amount, please help me out from this rediculous matter and to get my money as soon as possible or else i will take further action against lic india pvt ltd.
