Death claim- regards

My brother in law was died on 30.1.2008 by road accident. he was insured his life by the policy made with lic of india. after his death we approach the company for claim the refuse our claim because my brother in law not having driving licence so it was not elligible for claim.

my doubt is if he was walk away in road and met accident is elligible but vehicle riding without licence is not-elligle is how...?

kindly request reply and ideas give me an early...
