Settlement not received from past 6 months

I have been waiting for my settlement from past 6 months. They have provided me the form 16 and said that they have completed the FNF but they still have not paid me the amount. everytime i send a mail to HR Head, he will forward it somebody and ask to revert. Each guy is taking about 15 days and does nothing,

The name of HR is Puskar srivatsava.

Is there a legal way to sue the company. They have to pay me about 12000. They also collected 10000 as shortfall of notice.

Please help.
