Non retrun of booking amount

I have applied for a car loan through Elite Carz & Financial Advisors Pvt. Ltd., ICICI Banking Corp. and made a cheque payment through Citibank cheque no. 891164 dated 15th Mar.11. They promised to pay that amount to Sunrise Hyundai and book the car. Because of some reasons the loan got rejected and I am calling them since last 20 days for my refund. To my surprise they have not booked any car at Sunrise and the amount is still lying with them. I have the bank statement proving the same and also the application no. of my loan request. Will it be possible to raise a FIR with EOW, Delhi Police to recover my amount?
