Non refund of token money

I took a test drive for Indica Vista, Tata motors from Concorde motors, Prabhadevi and was asked to pay a token money of Rs. 30, 000/- (Thirty thousand), which was paid by me through cheque. The car model was not yet sure from my end nor the dealer so I had asked the representative Ms. Sameksha Darekar, from Concorde motors to hold on and not to forward the cheque as there was another dealer, Wasan motors who were offering me more discount then concorde motors. But to my surprise the cheque for clearance by Ms. Sameksha. On asking her to get me back my cheque as I had decided to buy the Tata vehicle from Wasan motors, to which Ms. Darekar said that she will be returning me only Rs. 20, 000/- (Twenty thousand) out of the Thirty thousand Rs. which were paid to her and a amount of Rs. Ten thousand will be cut for cancellation of booking of car. I immediately brought to her notice that she had neither given me any receipt for the cheque and the booking of the car is done only when chasis number is given to the customer or booked in his name. Where as we had asked Concorde motors to hold as we had not even selected the model of the car. If the amount in full is not returned to me I would be compelled to take legal action against Tata motors for cheating the prospective customer.
