IFFCO TOKIO not paying for Gear Box

Hi, My new car Etios Liva met with an Accident. The car front and rear is damaged. So the gear box has seixed due to oil leakage. the Surveyor for IFFCO TOKIO is saying the gear box is not covered as it has seized due to consequences losses and I have to pay 80000 as its part cost.why would I pay 80000 Rs for it? Why is it not covered as it occured due to accident and not any mishandling.
