We have purchased the above vehicle through your authorized dealer M/s.O.S. Motors Pvt Ltd. Chopasni Road, Jodhpur – 342003 pursuant to revised quotation dated 28-06 for a price of Rs. 10, 90, 800/-. The said vehicle is with Airbag CRDe with MHAWK Engine (Sp. Edition). The said accessory i.e. Airbag facility provided in the vehicle is for the purpose of protection to the passengers in the event of any accident of the vehicle.

On 24-08 the said vehicle met with an accident at Udaipur Highway and the members of Shah family who were traveling in the said vehicle alongwith the driver are severely injured and are under treatment in ICU both in Breach Candy and Bombay Hospital. The Airbag system provided in the said vehicle was defective and was not in operation at the time of accident. The injuries to the Passengers occurred on account of defective Airbag system provided in the said vehicle and it is you as manufacturers of the said vehicle are directly liable and responsible for the injuries caused to the encumbrance of the said vehicle. Apart from causing serious permanent injuries to the persons travelled in the said vehicle, heavy medical expenses are also being borne on account of the defective system viz. Airbag provided in the said vehicle. The medical expenses so far incurred by us more than Rs. 15, 00, 000/-.

In view of the above, you are hereby requested compensate us the amount of Rs. 15, 00, 000/- incurred by us on account of the said injury which caused due to the manufacturing defect of the said Airbag.
