Oil sump damaged, engine seized, no waranty for engline nor insurance claims

I have maruti zen estillo, bought on nov. just before 3 months and while driving, the oil sump got hit on a speed braker, and which got leaked, the oil leaked for few days, as i had it parked for a week.while driving after a week, i saw the oil leakage indicator on dashboard. so i was taking it to service station, while on the way, the car stopped. it was doved to the serivce station, and the mechanics there told, the engine would have got seized, due to no oil in the oil sump. they said i can only claim for the oil sump, as it was damaged in accident, which would cost only rs 1300. but i have to pay for the engine damages, nearly 40thousand as the engine was damaged.

why they dont have any oil sump guard, which is just few 6 to 8 inches above the ground level, and why they dont give warranty to the engine or why i cant claim for the engine thought insurance.
