Gini and jony - Garment Company-victimized me, not ready to refund deposit

Brief Details of the Case ….

I have been victimized by one of Mumbai based Garment co.[Gini and jony- franchiser] Despite Issuing Deposit certificates and commitment confirmation, not ready to refund Security Deposit and cost of Interior's, as communicated while handing over the store.

Amount involved is huge and vintage in one and a half year.

To be more precise, this case has occurred due to acute FINANCIAL CRUNCH faced by company and company could not withstand in front of the pressure of Increased Debt, also due to low ethical and professional standard and Integrity Issue. Gini & Jony have failed to adhere to the repayment schedule of their debt and have thus approached bankers to restructure the payment schedule. Hence trying to retain the low cost / no cost funds held with them.

01. Expenditure made towards development of Store till date Rs. 400, 000/- by me.

[Commitment communication for refund sent by company on 01/05 ]

02. Security Deposit attracting Interest, paid to company by me ……

a. Rs.100, 000/- paid on date 2nd septber 2010. [ Receipt received ]

b. Rs. 400, 000/- paid on date 28th December. [ Receipt received ]

Thus amount under dispute as on date is Rs. 950, 000/- as Rs.5.50 lakhs as S.D & Interest along with Rs. 4.00 Lakhs towards Store Development cost.

Around one and a half year back, I have approached the company for going ahead with franchise store at Hyderabad by Using Bank Finance, and thus help is needed for smooth completion of Loan Procedure. Subsequently, finalized property at Dilsukhanagar, Hyderabad.

Time and again, I was blindly believing in the company and its staff, as they ware promising me for Full support.. I started Store Development work. Till date I have made expenditure of Rs. Four lakhs for the same

In between I tried my level best for getting Bank Loan, BUT, Failure by company to produce the required documents, despite confirmation through various mails from staff and also twice from M D of company, was the Main reason, by which I could not get the Bank Finance to go ahead with this project. Bankers simply followed me to prove the OWNERSHIP of goods, which the company has failed to provide me till date.

Further company through other mail, on 27/04, sent letter dtd. 25 /04stating TERMINATION of the MOU. [I also, through letter informed that, contents of the letter are not at all ACCEPTABLE to me on the same day.] In the same letter they promised for Refund of Security Deposit within 30 days, which till date they have not refunded. I have handed over store keys to company, as I received mail communication dtd 01/05 stating reimbursement of Store Development Expenses to the tune of Rs.4.00 lakhs on same day.

There is a very huge correspondence, over mails and some letters too.

Now company Informed me that, they will Not Refund my Full Security Deposit with Interest.

and also will not Reimbursement of the Store Development Cost to the tune of Rs 4.00 lakhs

please help me to get the following….

01. Company has to reimburse the interior cost of Rs.4.00 lakhs

02. Company has to refund Security Deposit of Rs.5.00 lakhs and along with Interest till date of payment.

03. Company has to return me Three SIGNED undated Blank Cheques, held with them.
