Damaged Sarries

On 31st March we have purchased a bunch of 7 saries and 5 saries (Total 12 saries) and other cloths (Total Rs. 9, 900) from M/s. Dehali Vastra Bhandar, Chandrapur. On reaching home we checked the cloths and found that out of 07 saries 3 saries were damaged, there were minor holes and in some places the quality of the cloth was rough. And in one sari there were bad patches. The total cost of these 07 saries were Rs. 5560/- On 1st April, Sunday, shop was open. We shown the damaged saries and returned the whole lot of 7 saries and requested him to return our money. Despite our repeated request he asked us to choice another lot 7 of saries and after adjusting the bill he owed to us Rs. 530/- We were doubtful that this lot is also of old and damaged cloth but he did not listened to us and compelled us to buy from his shop only. On returning home we carefully checked all the cloth and found that in 1 sari there is small hole at bottom, the cloth was old type. Again we visited (4th April) his shop and requested him to return our money and we do not want any sari from his shop as HE HAVE OLD & DAMAGED STOCK. Neither he listened to us nor returned our money and intimated us to go to any consumer court or elswhere "Mai Tumhe Vaha par Dekh Loonga"

My question is:

1] Whether it is mandatory to buy material against damaged goods though the customer is not interested to buy.

2] Is it not RIGHT of the consumer to ask for money return instead of buying against the damaged goods.

3] Whether we can go in "Consumer Forum" to get return money. It is not a matter of Rs. 575/ but matter of CONSUMER RIGHT

4] Can somebody help (We have the bill of purchasing and adjusted amount and repurchased cloth)

We request all not to visit "Dehali Vastra Bhandar" for purchasing. The shopkeeper is very rude and admant behaviour.
