EF claim not yet received

I am ex-employee of MagnaQuest Technologies, Hyderabad. Its been now more than 7 months since i left the company. I applied for withdrawal of PF 2months back but till date the company is not submitted my forms to PF dept. When i asked why it was not submitted the answer was since the companies contribution of PF was not yet done from last 2 years so it is not possible for the company to submit the withdrawal form to PF dept.

Can somebody help on this regard. Isn't there any rule from govt to restrict such cheating by companies or its a govt's idea to loot employees under the name of welfare.
