Non Maintenance

We had rented a flat at this society in March. We have to pay Maintenance charges of Rs1500/- pm to the society. This includes services of guard, RO water, normal water, cleaner etc and intercom. But though other services are OK but we have not received the intercom service for 13 months in the period of 19 months. We have been paying reqularly till March and when inspite of repeated written complaint, no service was provided we stopped the payment. Now in Oct i wrote a letter to them indicating the total maintenance charges penaly for late payment less non maintenance charges for intercom @300/- pm. They have given me the receiving but refuse to deduct the charges. When they can take penalty for late payment why they can't deduct for non maintenance.

Kindly inform can I take action against them and if yes what kind/procedure.
