Leakage from terrace of Building

We have water leakage Problem from Terrace of our Building since 5 years such that the plaster from the roof portion of my flat had come off and it was dangerous to stay in the flat.

We complained to Brihanmumbai Municipal Corporation (BMC) against the Plot Owner but they have taken no action against him so far.

As per our stamp paper agreement the Plot owner who stays in the same building is supposed to repair the External Leakage and the cost will be equally shared by all the flat owners of the Building. The Plot owner is deliberately harassing us as he wants to sell the Building for further redevelopment and earn lots of Money from Builders.

We do not want this and I want to put the Flat on rent.

Kindly let me know how to approach the Consumer Court for this problem and how to file a case against the Plot Owner?
