Teacher is asking to depromote the kid/child nursery

I joined my daughter into L.K.G who complete 3.5yrs as of June 1st 2010 to Kalpa school.

Class teacher is saying that the child should be put in nursery as she is not able not write alphabets (right curve, slanting line or zigzag) or hold pencil.

Not even a month the kid went to the school continuously... We asked them to give an month time to pick her up or change the kid but the class teacher is insisting we can give an week time, if can't then we will put the child in Nursery.

She got admitted for LKG by having oral interview with child and principle and chairman.

is there any rule like that? that a kid can be place to the lesser class if he or she is not able to be up to the mark of the class teacher. Class teacher is saying the she is expecting 100% result. So she can't take any opportunity to have my kid in LKG where as she will be placing her in nursery.

Please let me know as whether any school/teacher can put the kid from LKG to nursery?
