Blackberry Handset is very Bad

I have a Blackberry Handset 9630 Tour in feb month and the moment it started working on Tata Network. Now handset getting restart automatically 8 & 10 times in the single day battery backup time also got less very much. For the same I was complaint on helpline of Tata (18004190121) they ask me " arrange to check this handset from service centre than I tell him service centre is so far from my location I am unable to visit there. Given details of service centers are so far like (150 K.M. Delhi, Chandigarh 235 K.M.)

My issue is that Why handset got many problems with in short time? Month back handset tark ball stop the working, Handset colors also got fad that time also they suggest me visit to service centre how it possible I am visit 150 K.M for a small problem.

Why company selling in the area where they unable to provide service?

I am extremely dissatisfied and have not been able to get throught their lousy customer service. I want to replacement.

Please let me know what can I do and If I should file a Legal Complaint for my refund.
