Micromax Q5 not working properly

I had brought a Micromax Q5 mobile in April. Ever since i had brought the mobile, i am facing problems. The phone always goes to 'Headset" profile even though the earphone is plugged out. This results in mine always using head set. Further, the company had promise that the phone is having '1000 sms storage'. However, in reality the phone can only store about 370 SMS. I think the company has cheated me by wrong advertisement and supplying phones with inbuilt deficiencies. I am planning to approach a Consumer court if the Micromax doesn't rectify the problem.
