Cheating me by not suppling E71 mobile phone

Sir,
I have seen E71 dual sim mobile phone on Ebay. On given number I enquired and as per his instruction I deposited Rs. 3100/- in Bank account in Aundh road branch (Pune) on his name on 19th Jan. After confermation he promised me that he will supply thye said item within a week. But till today he is not delivered me the mobile phone. Regarding this I complaint with ebay. As I am not rembering the Item code Ebay is enable to take any action on concern person. I talked with Kunal, he told me that he is in problem and is ready to refund my money. But till today he is not refund me any amount.
