Phone has stop charging & when the phone was received it has lot of scraching to it looks like second hand handset

Phone has stop charging exact after 2 weeks upon receipt of the handset & when the phone was received it has lot of scraching to it looks like second hand handset. Also package recvd missing bluetooth & ear phone..

On 17/1 i have sent the request & they insure me that with in 48hours the problem will be resolve, after this have again called on 19/1 7 same answer has been given & after i have called 1/21 & same answer but till date the phone has not been replaced & rectified.
