Complaint against Website Develope

Hi

I wanted to start a B2C website, But my website developer had cheated me, he left the project incomplete. In his e-mail he confessed that the project got delayed by him & I’m facing big losses due to him even on the phone he agreed the same. Now he is not ready to refund me my money Rs.30000/-, this amount was a part payment of the deal. Even asking repeatedly for the he had not given me any Bill, now he is saying that Rs 30000/- is a Fees for Hosting. I confirmed from other website developer the price of hosting is not so costly, at present my website is on.PHP server which is Joomla based.

Please can anybody guide me where do I complaint against the developer, What proof do I need to sue him. you contact me on savlamayur@gmail.com, Savlamayur@indiatimes.com.
