Website is down every day for hours

I purchased a new hosting plan form the site "mochahost.com" till that day my site is down for hours every day. When i contact them they always say this will be fixed soon etc. but after 1 and a half month it not fixed yet.

Anybody will help me how to get legal action again them and get it fixed and also the compensation for this harassment from the mochahost.com providers.
