Penalty of extra elect.load

Rented small shop--elect.load 2kw. I installed new 1Ton AC and an old 6 liter geyser in april'10 and I went to sdo for extra load in may'10, he asked me to go to JE for total load. JE made an "ELECTRIC CONSUMER CHECKING REPORT" on 17th may'10 showing DEMAND 2.4 and total equipments' load is 3.7 then asked to pay the penalty.

I want to know Is this right to penalize when i myself asked for the check n not the other way? If it is right, then how much penalty amount will i have to pay?
