Damaged microwave not received

I had ordered a a microwave combo vide order number 040123170. The microwave was received in damaged condition and was returned bck on 18.10.08 and received by AVA by 21.1008 . SInce then I have not receive the replacement microwave an am still paying the EMI. No service is being given to me and there is absolutely no use talking to the idiots sitting in the customer care. They have no info on the stataus and they just give excuses. Now I am contemplating takin action against the Company and HDFC that gave me that offer. Please guide me on how to go ahead with it.
