Delaying in making refund of earnest money

I had booked a flat with M/s Buildtech Engg & Developers on 13.01.09 by making payment of 20% flat value. We had decided to cancel the booking and wrote a letter to builder on 25.01. which he has acknowledged. After having a meeting at his office, we have been asked to wait for 45 days (as per company policy). Now its more than 70 days we are just been fooled around by builders staff by giving false promises to buy time. They neither respond to our calls nor give us anything in writing whichwill put us at ease. Can you pls help us in getting the refund of booking amount from this builder.
