Denial of precessing a refund of booking amount by the company

Hi. My name is Ajay Singh. I am going to share the worst experience of my life time with MARUTI true value and expect that this will be communicated to the top management. On 19/11, I booked a car # DL9CJ4332 (Maruti 800 2004 AC Model) at Competent Automobile at 21 Shivaji Marg, New Delhi. I booked this car without seeing it because my sales rep. Gaurav Mongia convinced me to pay 1300 booking amount on promise that upon looking at the CAR if I would not like it I can get the refund of this amount. When I looked at the car, I didn’t like it but we let the money kept with Mr. Gaurav with the understanding that he would inform us about any new car that would fit in our budget upon its arrival. Moreover, while signing the booking form, I pointed out that the booking form says that this amount is non-refundable. On this Mr. Gaurav said that this just mentioned on the form but it doesn’t have any relevance and assured us that we would get our refund if we don’t purchase the car. Moreover, when I called Mr. Gaurav a few days back he informed me that his manager is not available in town until Jan 5th and asked me to come on 6th to collect the money. He again assured me that he would get us the refund. On January 6, when I called him up and asked if I can come to collect the refund today, he said that his manager has denied to refund but if he would come and fight we will get the amount but asked me not to share this information with his manager. All this conversation can be asked by the court from the telecom providers (if this matter is taken to the court). More-over call records can be shared from both the parties for over a period of last 2 months to show how many calls were made by Mr. Gaurav to me regarding any new CAR after we saw the booked car. On January 7, when I went to Competent Automobile, I was treated like a stupid foolish man. When asked for refund Mr. Gaurav accepted in front of his Manager Mr. Neeraj that he committed for it but also said that now they are not refunding this amount as it is against the policy and it was already mentioned on the booking form that it was non-refundable. Mr. Neeraj also acknowledged that Gaurav would have said that we will refund the money but he is not processing this request and asked us to deal with Mr. Gaurav directly. Mr. Gaurav threatened us to do whatever we want to, but they will not refund the money. I know that by just going through a booking form, I may not be able to proof that I was told that the amount will be refunded; however, I am willing to take this matter to consumer court and to media so that other people cannot be fooled by True Value like me. I will be forced to file a petition against True Value if this claim is not settled within 7 days of cheating and harassment. Needless to say, people like Mr. Gaurav Mongia and Mr. Neeraj are bad spot on True Value and can easily spoil the name of such a reputed company by their acts. I would expect your management to look in to this matter ASAP and take corrective actions otherwise; this matter will be taken over to the court of law of India.
