Our society is a mix of 1BHK and 2 BHK flats which are of varied sizes (sqft). A decision was taken in general body meeting to apply the charges per sqft basis, but the chairman and secy used its influence to scrap that decision and continued with fixed charges which are not equally distributed and calculation of the charges are suspicious. The reason they gave was that calculation of charges per square feet basis is illegal but they did not provide this in writing when I requested for it. Further, they are not maintaining the amenities of the society and when asked the reason for this, they would say that we do not have sufficient funds.

Could you please guide me with legality of the issue so that these could be corrected-

1. All components of maintenance charges should be calculated on sqft basis (being a society of flats with different sizes).

2. Legal guideline on application of late fee

3. Action on non-maintenance of amenities.
