Negligence of govt hosp

In govt. hospital (yavatmal dist.). when patient was gone for treatement, there doctor suggest to patient

for certaintest including biaspy (for cancer test). patient done this test in govt. hospital yavatal, and report says patient have carcinoma that means cancer.

when paitent went for his further tratement in cancer hospital at nagpur which is privete hosp. they asked repate the above test, after doing that test, there is nothing like carcinoma and other thing like that in that report. paitent repated this test in various city n differnt pathology labs. there are nothing carcinoma cells . means patient have no cancer.

now in such condition patient want to go to in consumar court against govt. hospital . my quation is that can we go to against govt hospital for negligence in such court, bcoz i heard that when patient taken treatment is free of cost then he cant complaint against govt hosp. if we can do it then who will parties?
