Debit/hold account without notice and not submitting documentary evidence

HDFC Bank have put a hold on Rs 36702.08 from my savings bank account on 17.4.08.(seen by me on 18.4.08) Asked they say it is due to old credit card balance. Now they have issued me a Gold Credit Card which I have never used and not even opened their courier thru which the Gold Card was delivered and same have been confirmed by HDFC Saltlake, Kolkata Branch Manager, Mr. Bikramjit Mitra.

Moreover they have not even bothered to give notice to me or any sort of communication to me that they are putting an hold on an amount from my savings bank.

Now enquiring they say it was a old Silver Card on which I have a balance.(Do banks issue new credit cards to the same holder when he has an outstanding on an old card? -I believe never).

I have asked for the documentary evidence for the same but they are not ready to provide any and taking me for a round and delaying everytime I ring them as they believe they have my money at their disposal and they can do whatever they want to do with the amount.

Who will bear the cost of lost opportunity/ lost interest on my hold back amount?

This tantamounts to cheating under Sec 420 of criminal Act and holding of information uder Right to Information Act.
