Subject: Legal notice for deficientnegligent service of H.D.F.C. Bank in respect of Ac No.-121401000004541 State of branch Sec-17 Chandigarh.

Sir,

On behalf of my client S. Jarnail Singh Dulku 1-Coriander Gardens, Little over Derby DE23 2UB (England). I hereby serve upon you the following legal notice.

1. That my client transferred 17500 Pounds on 16.09.08 from their Alliance and Leicester Bank derby (U.K.) account through Standard Chartered Bank Mumbai to the account of Sri Guru Granth Sahib Sewa Society (Regd) no.-121401000004541 held in H.D.F.C. State Branch Sector-17 Chandigarh.

2. But vide message dated 26.09.08 (Copy enclosed) payment processing center informed that funds are being returned because beneficiary bank i.e.H.D.F.C. has not accepted the payment because of “invalid Account number” inspite of the fact that the Ac no. with H.D.F.C. Sector-17 of Sri Guru Granth Sahib Sewa Society is fully operative and valid.

3. Due to deficiency negligence on the part of H.D.F.C. Bank the account of my client was credited on return of funds to the tune of 16028.15 Pounds instead of 17500 pounds, because of the change of exchange rate between the period of sending funds to India and return of funds to U.K. Thereby my client suffered a loss of 1471.85 pounds due to negligence of your Bank.

4. The funds were to be used for booking of a flat with Sri Guru Granth Sahib Sewa Society but the transaction failed because of negligence of your bank and the rate of the flats in the mean while increased by Rs. 4 lacs which my client had to pay.

In view of the above I hereby serve upon you with this legal notice to pay to my client 1471.85 pounds as difference of funds remitted from U.K. and refunds received on return from India, In addition to Rs. 4 lacs for the loss suffered due to increase in rates of flat and Rs. 100000 as compensation for mental harassment along with 12% interest till date, With in 1 month of the receipt of this notice.

Incase you fail to make payment within stipulated time, legal proceedings in competent Court of Jurisdiction shall be instituted against you and for all cost and consequences you shal be responsible.
