Spice hotspot retails has cheated me

I submitted handset for minor fault on 29-07.due to some reasons store has been closed whre I submitted the same, now I recieved a call from the store manager on dated 15-09 to collect the handset from tagore garden, they are trying to give me a old handset replacment of my handset, bcoz they said my handset is lost by the service centre, Why should I take a old, poor n tuta futa handset in replacment of my new handset.
