Cheated by Hot Spot Mobile shop

I purchased BlackBerry 8900 mobile phone from “Hot Spot” located in Sahara Mall Gurgaon for Rs 23000/- today (12/07). When I tried to use the hands free at home on the same day, I realized that the connection to hands free is loose and does not work correctly. I called back the hotspot store and told him the problem. Instead of replacing my mobile phone the Hot Spot guys told me that it is not their responsibility if there is some problem with the phone as I have not purchased additional insurance of wear and tear of Rs. 1500/- from them. As the phone is having manufacturing defect so it is the responsibility of Hot Spot to replace it but they are not ready for it. Please help me how can I get my phone replaced.
