Defective phone supplied

Hi all, My brother gifted me an HTC Touch P3452.By the time it reached my hand the replacement period (14 days from purchase) was over. When I started using it i found It often gets shut down automatically. I called up the customer service and asked about the possibility of replacement. But they told no, Then I sent it to service center. After 1 month I got it from the service center. Now I used it for 1 and a half days, again the same problem propped up. I really doubt whether I have got a defective product.

I am agonized that I haven't even used the product for 2 days together. Its more of a mental trauma than financial loss (It was a gift).

What is the possibility for me to get my set replaced?
