They are fraud. They wont give your money back

I am still waiting on my $300 check. I paid $369 for filing my itemized returns. After doing so, they updated me that they cant to itemized since I dont have an IRA account. So they said they will charge $69 only and will return my $300 back. Till date I have sent several emails for my refund, for which I get a reply saying "We have mentioned to the corresponding department, we will get back shortly". Even the text doesn't change for the emails. What would be the difficulty for a company to return back $300 which they are not supposed to hold. I am being hassled for the past 4 months on this issue with no clear updates.
