ICICI Bank Personal loan
EMI ECSstarted without receiveing the amount

My loan from ICICI bank got disbursed in FEB.I still haven't received my amount which was supposed to be delivered via cheque to me. I have called customer care 5 times now. Its beeen over a month and everytime i get a reply saying someone will get back to me in 2 days. On top of that they have also started my EMI.I can not beleive that i am paying the EMI for the money i haven't received.

Does any one know how can i take a legal action against them.
