Huge billing shown in statement

i have paid the due of icici credit cared of Rs-37500/- via a cheque on 30.06.2008 drawn on axis bank, but bank has said the has return, so i paid second chq of same amount but bank has sent both chq to my bank for clearing and get the cr of one chq and another got cda.

bank has sent even the recovery agent to collect the above money.

since 08.07.08 i have sent many email n phone to bank but no reply my card is block since then till today, who will pay the Rs400- of cda charge by my axis bank due to icici fault.

i want to take the icici to consumer court for cheating, defficenecy in service and use of recovery agent to collect the money which i have already paid by chq.
