Sub.: NOTICE FOR NON ISSUANCE OF TDS CERTIFICATE ON FORM 16A.
Ref.: Tender no. 109 – Ajmer Division – Testing of Arch Bridges for M.B.G. standard loading between Madar –Palanpur Section (126 Nos.) Phase-II.
(i) Our letter no. SPAGE: NWR-AII-wa-109-10 of 20.03.08 to SrDEN (S)/NWR/Ajmer.
(ii) Our letter no. SPAGE: NWR-AII-wa-109-11 of 21.04.08 to SrDEN (S)/NWR/Ajmer.
(iii) Our letter no. SPAGE: NWR-AII-wa-109-12 of 07.07.2008 to GM/NWR/Jaipur.
Dear Sir:
Despite our requests as referred above, we have not received the TDS certificate for the Income Tax deducted at source from the payments made to us during the financial year 2006 and 2007.
As per Income Tax Act Section 272A (2) (g) the deducting authority shall issue such certificate within one month from the end of financial year, failing which he shall pay, by way of penalty, a sum which shall not be less than one hundred rupees, but which may extend to two hundred rupees, for every day during which the failure continues.
In view of above provision, the onus for issuing such certificate lies on the railways, which may please be noted. Your needful intervention in the matter is, therefore, requested.
